　 根据《刑诉法》第42条的规定，证明案件真实情况的一切事实，都是证据。可以作为证据的有：物证、书证；证人证言；被害人陈述；犯罪嫌疑人、被告人供述和辩解；鉴定结论；勘验、检查笔录；视听资料。
　　当这些证据经过查证属实后，就能作为刑事诉讼中定案的根据
