法定继承人继承是否有顺序

我国《继承法》第10条明确规定：遗产按照下列顺序继承： "第一顺序：配偶、子女、父母。第二顺序：兄弟姐妹、祖父母、外祖父母。继承开始后，由第一顺序继承人继承，第二顺序继承人不继承，没有第一顺序继承人的，由第二顺序继承人继承。" 我国《继承法》只规定了两个继承顺序，在同一个继承顺序中的继承中不在有先后顺序之分，同一顺序中的继承人对被继承人的遗产享有平等的继承权利
