劳动争议程序的主体双方是否可以都为个人？

劳动争议案件的主体是否双方都可为个人？

2010年以前，双方主体为个人的劳动争议在程序上是不允许的。但是（2010年7月12日最高人民法院审判委员会第1489次会议通过）的《关于审理劳动争议案件适用法律若干问题的解释（三）》

第四条　劳动者与未办理营业执照、营业执照被吊销或者营业期限届满仍继续经营的用人单位发生争议的，应当将用人单位或者其出资人列为当事人。
 
按照这个规定，个人没有办理营业执照而雇佣形成稳定劳动关系的员工，此个人可以作为劳动争议案件的主体。
